Terms of Service
The short version
Hawkpost coaches your X account. You stay responsible for everything posted from it, we never promise a particular amount of growth, subscriptions are monthly and you can cancel any time, and if we get something badly wrong our liability is capped at what you paid us in the last twelve months.
1. Who you are contracting with
Hawkpost is operated by CodeHawks, based in Folkestone, United Kingdom ("we", "us"). These terms form a contract between us and you, the person or organisation using the service. If you are agreeing on behalf of a company, you confirm you are allowed to bind it.
By creating an account or connecting an X account you accept these terms. If you do not accept them, do not use Hawkpost.
2. What Hawkpost does
Hawkpost reads data about your X account, works out which growth stage it is in, and produces a daily plan, a weekly review, drafted content, and an achievement record. It can publish posts you have written or approved, on a schedule you set.
Hawkpost is a coaching and publishing tool. It is not a guarantee of any outcome. See section 8.
3. Your X account
You connect your X account using X's own authorisation flow. We store the resulting access tokens encrypted and use them only to provide the service. You can disconnect at any time from your X account settings or by deleting your Hawkpost account.
You are responsible for making sure that:
- you own the X account, or have permission from whoever does, and that permission is current;
- your use of Hawkpost complies with X's Terms of Service and its developer and automation rules;
- everything published from your account is lawful and something you are happy to stand behind.
X can change its rules, pricing or access at any time, and can suspend accounts. If X restricts our access or yours, parts of Hawkpost may stop working. That is outside our control.
4. Content, including AI drafts
You own what you write. You keep all rights in your posts, drafts, notes and uploaded images, and you grant us only the permission we need to store them, show them back to you, and publish them to X when you ask.
Hawkpost drafts content using AI models. Those drafts are suggestions. They can be wrong, generic, or unsuitable. Nothing is published until you approve it or schedule it, and once you do, it is your post and your responsibility. Check facts, numbers and claims before publishing. AI output may not be unique to you, and we make no claim that it is protected by copyright.
Do not use Hawkpost to produce or publish content that is unlawful, harassing, deceptive, that impersonates somebody, that infringes anyone else's rights, or that breaks X's rules.
5. Acceptable use
You agree not to:
- use Hawkpost to send unsolicited bulk messages, engage in follow or engagement farming, or operate networks of accounts designed to mislead;
- resell, sublicense or white-label the service without our written agreement;
- attempt to work around the data allowances, rate limits or plan limits described on the pricing page, including by scripting the interface;
- probe, scan or interfere with the service's security, or access another customer's data;
- use the service to build a competing product from data you obtained through it.
We may suspend an account immediately if we reasonably believe it is being used this way, or if continuing would put our access to X at risk.
6. Plans, billing and cancellation
Free trial
Every plan starts with a three-day free trial. We take your card at the start of it and charge nothing until it ends, so cancelling inside those three days costs you nothing. One trial per customer. There is no permanently free plan: until you subscribe, or after a subscription ends, the coaching features are locked and nothing is deleted.
Paid plans
Paid plans are billed monthly in advance through Stripe, in pounds sterling or US dollars depending on your location. Stripe is the merchant of record for Hawkpost and adds any VAT, GST or sales tax due in your country at checkout. We never see or store your card details.
Cancelling
You can cancel at any time from your account settings. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. After that the coaching features lock. Your posts, achievements, Growth Network and history remain, and subscribing again restores access to them.
Refunds
We do not give partial refunds for unused time in a month. If Hawkpost was substantially unavailable for a sustained period, or you were charged in error, contact us and we will put it right. If you are a consumer in the UK or EU, your statutory cancellation rights are unaffected, though by starting the service immediately you accept that we begin performing straight away.
Price changes
We may change prices. If we do, existing subscribers get at least 30 days' notice by email and the new price applies from the next renewal after that notice. You can cancel before it takes effect.
7. Data allowances
Every plan includes a monthly allowance of X posts that Hawkpost will read on your behalf, shown on the pricing page. Reading X data has a real per-post cost to us, which is why the allowance exists and why we publish it rather than hiding it.
If you reach the allowance, data-gathering pauses for the rest of the calendar month and the rest of the app keeps working. Nothing is charged automatically for going over. You can upgrade for a higher allowance.
8. What we do not promise
We do not promise that you will gain followers, engagement, customers or revenue. Hawkpost gives you a plan based on what has worked for accounts at your stage. Whether it works for you depends on your niche, your writing, your consistency and a good deal of luck. Anyone selling you a guaranteed outcome on a social platform is not being straight with you.
We aim to keep Hawkpost available but do not commit to a specific uptime. We may change, add or remove features. If we remove something significant that you are paying for, we will tell you and you may cancel.
The service is provided "as is". To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Our intellectual property
Hawkpost's software, design, achievement artwork, coaching framework and written guidance belong to us. Using the service does not transfer any of it to you. You may not copy the achievement artwork or the stage framework for use in another product.
10. Ending the agreement
You can stop using Hawkpost at any time and delete your account, which removes your data as described in the privacy policy.
We may suspend or close an account if you materially break these terms, if payment fails and is not fixed after we have asked, or if we have to in order to comply with the law or keep our X access. Where it is reasonable to do so, we will warn you first and give you a chance to fix it.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.
Otherwise, and to the extent the law allows, we are not liable for lost profits, lost revenue, lost followers, loss of an X account, loss of goodwill, or indirect or consequential loss. Our total liability for all claims in any twelve-month period is capped at the amount you paid us in that period, or £100 if you have not yet paid us anything.
You are responsible for what is posted from your X account, including anything Hawkpost published at your instruction, and for any claim arising from it.
12. Changes to these terms
We may update these terms. If a change materially reduces your rights, we will give at least 30 days' notice by email or in the app. Continuing to use Hawkpost after a change takes effect means you accept it. The date at the top of this page always shows the current version.
13. Law and disputes
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living elsewhere in the UK or in the EU, you keep the right to bring a claim in your local courts and the benefit of your local consumer law.
Before going to court, please contact us. Most problems are quicker to solve by email.
14. Odds and ends
- If any part of these terms is unenforceable, the rest continues to apply.
- Not enforcing something straight away does not mean we have given up the right to enforce it later.
- You may not transfer your rights under these terms without our agreement. We may transfer ours if our business is sold, provided your rights are not reduced.
- These terms and the privacy policy are the whole agreement between us about Hawkpost.
- Hawkpost is an independent product. It is not affiliated with, sponsored by, or endorsed by X Corp.
